When a person is facing removal from Canada, it is sometimes possible to apply for a stay of removal, i.e. a temporary suspension of removal. There are two types of stay:

  • The administrative stay, applied through Canada Border Services Agency (CBSA), is based on humanitarian grounds or exceptional circumstances.
  • A judicial stay, on the other hand, is requested from the Federal Court as part of a judicial review of a removal decision. It generally requires an application for leave and an urgent order from the Court.

These procedures are often complex and need to be presented quickly, with solid arguments and relevant evidence.
